India’s Techno-Legal Path to AI Safety: Balancing Innovation and Regulation

India is emerging as a key player in shaping how artificial intelligence will be governed in the years ahead. Unlike countries that rely primarily on heavy regulation or those that let technology evolve with minimal oversight, India is adopting what Minister of Electronics and Information Technology Ashwini Vaishnaw calls a “techno-legal approach.” This model blends technological solutions with carefully designed legal safeguards, allowing the country to foster innovation while addressing the risks of misuse.
The announcement was made during the launch of NITI Aayog’s initiatives—“AI for Viksit Bharat Roadmap” and the “Frontier Tech Repository.” Vaishnaw stressed that India’s preference is to prioritize innovation when regulation and innovation are in conflict, distinguishing the country’s approach from Europe’s more regulation-centric stance.

The IndiaAI Safety Institute
At the heart of this strategy is the IndiaAI Safety Institute, designed not as a single institution but as a virtual network of specialized nodes. Each node focuses on solving specific challenges in AI safety, such as bias, misinformation, ethical usage, and privacy. This distributed structure ensures flexibility, allowing stakeholders from academia, industry, and government to collaborate effectively while tailoring solutions to India’s unique linguistic, cultural, and socio-economic diversity.
The institute also reflects India’s belief that AI systems must be inclusive and rooted in indigenous datasets. By involving diverse communities and focusing on localized problems, the government aims to build AI that is not only technologically advanced but also contextually relevant and trustworthy.
Strengthening Infrastructure and Capacity
India’s techno-legal strategy is supported by massive infrastructure investments under the IndiaAI Mission, a program with an allocation of nearly ₹10,000 crore. As of 2025, the country has already deployed more than 34,000 GPUs, surpassing the original target of 10,000, with plans to scale up to 38,000. These GPUs will power large-scale research, model training, and innovation across sectors.
Complementing this effort is the creation of 600 data labs across India, which will serve as key hubs for research, experimentation, and AI model development. These labs are designed to democratize access to compute power and data resources, ensuring that smaller institutions, startups, and research groups can contribute meaningfully to India’s AI ecosystem.
Responsible AI and Ethical Research
Beyond infrastructure, the government is investing heavily in responsible AI research. Through the “Safe and Trusted AI” pillar of the IndiaAI Mission, projects are being supported to study and mitigate risks, build frameworks for ethical use, and strengthen public trust. These initiatives reflect India’s understanding that AI safety cannot be treated as an afterthought but must evolve alongside technological progress.
Such research is crucial given AI’s expanding role in everyday life. From healthcare and education to finance and governance, AI is transforming how Indians live and work. At the same time, challenges like bias, privacy concerns, and disinformation demand constant vigilance. India’s techno-legal model, with its balance of innovation and oversight, is intended to meet these challenges without stifling growth.
Economic Stakes and Global Role
The stakes for India are not merely technological but also economic. According to a NITI Aayog report, AI adoption could add $500–600 billion to India’s GDP by 2035, with the manufacturing and financial services sectors expected to benefit the most. The government’s AI push is thus both a safety strategy and an economic growth strategy.
On the global stage, India is positioning itself as a leader in AI governance. By hosting forums such as the AI Impact Summit and participating in international collaborations, India is working to shape global norms on AI ethics and safety. Its unique techno-legal model, if successful, could serve as a blueprint for other developing nations navigating the same balance between innovation and regulation.
